Terms of Use

1. About Tinta

Tinta ("Tinta", "the App", "we", "us", or "our") is an iOS coloring book app that lets you play color-by-number pages, create coloring pages from photos, and use optional AI creation features where available.

These Terms apply to your use of Tinta, including any pages, daily unlocks, rewarded ads, subscriptions, updates, and related services made available through the App.

2. Eligibility

You must be at least 13 years old, or the minimum age required in your country or region, to use Tinta. If you allow a child to use Tinta, you are responsible for that child's activity and for any purchases or settings connected to your Apple Account.

3. App Store terms

Tinta is distributed through the Apple App Store. These Terms are between you and Tinta, not Apple. Tinta, not Apple, is responsible for the App and its content, except where Apple's mandatory terms or applicable law provide otherwise.

Your use of Tinta may also be governed by Apple Media Services Terms and Conditions, Apple's Standard EULA, App Store rules, and your Apple Account terms. Apple is not responsible for maintenance or support for Tinta except as required by law. Apple and its subsidiaries are third- party beneficiaries of these Terms and may enforce them against you.

4. License to use the App

Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to use Tinta on Apple-branded devices that you own or control, as permitted by Apple's App Store rules.

You may not copy, modify, reverse engineer, decompile, disassemble, sell, rent, lease, sublicense, distribute, or create derivative works from Tinta, except where applicable law expressly allows such activity.

5. Your content

You are responsible for photos, prompts, instructions, coloring pages, exports, and other content that you import, create, generate, edit, or share using Tinta ("User Content").

You retain ownership of your User Content. You grant us and our service providers a limited license to process User Content only as needed to provide, maintain, secure, and improve Tinta's features, including photo-to-coloring-page and AI creation features that you choose to use.

You represent that you have all rights and permissions necessary to use your User Content with Tinta. Do not use Tinta to create, upload, or share content that infringes someone else's rights, violates privacy, or breaks the law.

6. AI creation and generated output

Tinta may offer AI-assisted features that create or transform coloring pages from photos, prompts, or other inputs. AI-generated output can be imperfect, inaccurate, unexpected, or similar to other generated content.

You are responsible for reviewing generated output before relying on it, sharing it, selling it, submitting it, or using it in any public or commercial context. Tinta does not guarantee that generated content will be unique, non-infringing, or suitable for your intended purpose.

7. Gameplay, unlocks, and rewarded ads

Tinta may offer free pages, locked pages, daily free unlocks, completion rewards, and optional rewarded video ads. Rewards, unlocks, ad availability, page availability, and timing may vary by region, device, app version, subscription status, and technical conditions.

Rewards and unlocks have no cash value, are not transferable, and may not be sold. If a rewarded ad is unavailable, fails to complete, or cannot be verified, Tinta may be unable to grant the reward.

8. Subscriptions, billing, and renewals

Tinta may offer auto-renewable subscriptions such as Tinta Pro. Available plans, features, pricing, free trials, and billing periods are shown in the App and on the App Store at the time of purchase. Tinta Pro may unlock features such as the full library, unlimited AI pages, and an ad-free experience where offered.

If you purchase through the App Store, payment will be charged to your Apple Account. Subscriptions automatically renew unless you cancel at least 24 hours before the end of the current billing period. Your account may be charged for renewal within 24 hours before the end of the current period.

You can manage or cancel subscriptions in your Apple Account settings. Deleting the App does not cancel your subscription. Free trials, if offered, may convert to a paid subscription unless canceled before the trial ends. Refunds and billing issues are handled by Apple according to Apple's policies.

9. Acceptable use

You agree not to use Tinta to:

• violate any law, regulation, contract, intellectual property right, privacy right, or other third-party right;
• create, upload, generate, or distribute unlawful, harmful, abusive, deceptive, defamatory, obscene, or infringing content;
• impersonate another person or misrepresent your affiliation with anyone;
• attempt to bypass ads, rewards, usage limits, subscriptions, security controls, or access restrictions;
• interfere with, disrupt, overload, reverse engineer, scrape, or misuse the App, our systems, or our service providers;
• use Tinta to develop competing services in a way that violates these Terms or third-party terms.

10. Intellectual property

Tinta, including its software, interface, design, artwork, sample pages, templates, names, logos, and other materials, is owned by us or our licensors and is protected by intellectual property laws.

These Terms do not transfer any ownership rights in Tinta to you. You may use the App only as permitted by these Terms.

11. Privacy

Our collection and use of information is described in our Privacy Policy. By using Tinta, you acknowledge that your use is also subject to the Privacy Policy.

12. Third-party services

Tinta may rely on third-party services, including Apple services, ad providers, analytics and crash reporting tools, cloud infrastructure, and AI processing providers. These services may be subject to their own terms and policies.

We are not responsible for third-party services that we do not control, but we use them to provide and improve Tinta.

13. Disclaimers

Tinta is provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, accuracy, availability, and non-infringement, to the maximum extent permitted by law.

We do not guarantee that Tinta will be uninterrupted, error-free, secure, compatible with every device, or that any coloring page, AI output, ad, reward, subscription feature, or unlock will always be available.

14. Limitation of liability

To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or any loss of data, profits, revenue, goodwill, or opportunity arising from or related to your use of or inability to use Tinta.

15. Export and legal compliance

You represent that you are not located in a country or region subject to a U.S. Government embargo or designated by the U.S. Government as a terrorist-supporting country or region, and that you are not listed on any U.S. Government list of prohibited or restricted parties.

You agree to comply with all applicable export control, sanctions, privacy, intellectual property, consumer protection, and other laws when using Tinta.

16. Changes to these Terms

We may update these Terms from time to time. Material changes will be reflected by updating the effective date above. Continued use after changes means you accept the updated Terms.
