1. About SmartPDF

SmartPDF: Edit & Translate PDF ("SmartPDF", "the App", "we", "us", or "our") provides tools to import, view, edit, translate, summarize, and work with PDF documents using local PDF processing and AI-assisted features.

These Terms apply to your use of SmartPDF, including any features, subscriptions, updates, and related services made available through the App.

2. Eligibility

You must be at least 13 years old, or the minimum age required in your country or region, to use SmartPDF. If you use SmartPDF on behalf of a company, organization, or other entity, you represent that you have authority to bind that entity to these Terms.

3. App Store Terms

SmartPDF is distributed through the Apple App Store. These Terms are between you and SmartPDF, not Apple. SmartPDF, not Apple, is solely responsible for the App and its content, except where Apple's mandatory terms or applicable law provide otherwise.

Your download and use of the App may also be governed by Apple Media Services Terms and Conditions and Apple's applicable App Store rules. If there is a conflict between these Terms and Apple's mandatory terms, Apple's mandatory terms will control to the extent required.

Apple is not responsible for providing maintenance or support for SmartPDF, except as required by applicable law. Apple and Apple's subsidiaries are third-party beneficiaries of these Terms and may enforce these Terms against you as a third-party beneficiary. 4. License to Use the App

Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to use SmartPDF on Apple-branded devices that you own or control, as permitted by Apple's App Store rules.

You may not copy, modify, reverse engineer, decompile, disassemble, sell, rent, lease, sublicense, distribute, or create derivative works from SmartPDF, except where applicable law expressly allows such activity.

5. Your Documents and Content

You are responsible for the PDF files, text, prompts, instructions, and other content that you import, upload, generate, edit, translate, or process using SmartPDF ("User Content").

You retain ownership of your User Content. You grant us and our service providers a limited license to process User Content only as needed to provide, maintain, secure, and improve SmartPDF's features, including AI editing and translation features.

You represent that you have all rights and permissions necessary to use your User Content with SmartPDF. Do not use SmartPDF to process documents that you are not legally allowed to access, edit, translate, share, or upload.

6. AI-Assisted Features

SmartPDF may use artificial intelligence models and third-party service providers to help edit, translate, summarize, parse, or transform documents. When you run an AI feature, SmartPDF may upload the relevant document, page image, selected text, prompt, or instruction to an AI provider such as OpenAI solely to provide the feature you requested. AI-generated output may be inaccurate, incomplete, outdated, or unsuitable for your specific purpose.

You are responsible for reviewing and verifying all AI-generated output before relying on it, sharing it, submitting it, or using it in legal, medical, financial, academic, professional, or other important contexts.

SmartPDF does not provide legal, medical, financial, tax, immigration, or other professional advice. AI features are productivity tools only.

7. Subscriptions, Billing, and Renewals

SmartPDF may offer auto-renewable subscriptions such as Basic, Plus, and Pro plans. Available plans, features, pricing, free trials, and billing periods are shown in the App and on the App Store at the time of purchase.

If you purchase a subscription through the App Store, payment will be charged to your Apple ID account. Subscriptions automatically renew unless you cancel at least 24 hours before the end of the current billing period. Your account may be charged for renewal within 24 hours before the end of the current period.

You can manage or cancel subscriptions in your Apple ID account settings. Deleting the App does not cancel your subscription. Free trials, if offered, may convert to a paid subscription unless canceled before the trial ends.

Refunds and billing issues for App Store purchases are handled by Apple according to Apple's policies. We do not control Apple's refund decisions.

8. Acceptable Use

You agree not to use SmartPDF to:

violate any law, regulation, contract, intellectual property right, privacy right, or other third-party right;
upload, process, create, or distribute unlawful, harmful, abusive, deceptive, defamatory, obscene, or infringing content;
process documents containing sensitive personal information unless you have the right and authority to do so;
attempt to bypass usage limits, subscription requirements, security controls, or access restrictions;
interfere with, disrupt, overload, reverse engineer, scrape, or misuse the App, our systems, or our service providers;
use SmartPDF to develop competing models or services in a way that violates these Terms or third-party terms.

9. Export and Legal Compliance

You represent and warrant that you are not located in a country or region that is subject to a U.S. Government embargo or that has been designated by the U.S. Government as a "terrorist supporting" country or region, and that you are not listed on any U.S. Government list of prohibited or restricted parties.

You agree to comply with all applicable export control, sanctions, privacy, intellectual property, consumer protection, and other laws when using SmartPDF.

10. Privacy

Our collection and use of information is described in our Privacy Policy. Please review it at our Privacy Policy.

By using SmartPDF, you acknowledge that your use of the App is also subject to the Privacy Policy.

11. Third-Party Services

SmartPDF may rely on third-party services, including Apple services, analytics and crash reporting tools, cloud infrastructure, and AI model providers such as OpenAI. These services may be subject to their own terms and policies.

We are not responsible for third-party services that we do not control, but we use them to provide and improve SmartPDF.

12. Intellectual Property

SmartPDF, including its design, software, features, branding, logos, and related materials, is owned by us or our licensors and is protected by intellectual property laws. These Terms do not grant you any rights in SmartPDF except for the limited license described above.

If you provide feedback, suggestions, or ideas, you grant us a non-exclusive, worldwide, royalty-free right to use them without restriction or compensation to you.

13. Availability and Changes

We may modify, suspend, limit, or discontinue any part of SmartPDF at any time. We may update the App to add, change, or remove features, including AI features and subscription benefits.

We do not guarantee that SmartPDF will always be available, uninterrupted, secure, or error-free.

14. Termination

You may stop using SmartPDF at any time. We may suspend or terminate your access to SmartPDF if we reasonably believe that you violated these Terms, created risk or harm, or used the App unlawfully.

Upon termination, your right to use SmartPDF ends, but provisions that by their nature should survive will continue to apply, including ownership, disclaimers, limitations of liability, and dispute provisions.

15. Disclaimers

SmartPDF is provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.

We do not warrant that PDF processing, translations, AI edits, summaries, exports, or other output will be accurate, complete, legally sufficient, suitable for your needs, or free from errors.

16. Limitation of Liability

To the maximum extent permitted by law, we will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, data, documents, business, goodwill, or other intangible losses arising out of or related to your use of SmartPDF.

To the maximum extent permitted by law, our total liability for any claim relating to SmartPDF will not exceed the greater of the amount you paid for SmartPDF during the three months before the event giving rise to the claim or USD $50.

Some jurisdictions do not allow certain limitations of liability, so some limitations may not apply to you.

17. Indemnity

To the extent permitted by law, you agree to defend, indemnify, and hold harmless SmartPDF, its developers, service providers, and affiliates from claims, damages, liabilities, losses, and expenses arising from your User Content, your misuse of SmartPDF, or your violation of these Terms or applicable law.

18. Governing Law

These Terms are governed by the laws applicable in the jurisdiction where SmartPDF is operated, without regard to conflict-of-law rules, except where the laws of your country or region require otherwise.

19. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we may notify you through the App, on our website, or by other reasonable means. Your continued use of SmartPDF after the effective date of updated Terms means you accept the updated Terms.
