1. About PicKeeper

PicKeeper: Photo Cleaner ("PicKeeper", "the App", "we", "us", or "our") helps you review your photo library on your device: it finds duplicate and near-identical shots, picks the best photo out of a burst, groups screenshots by their content, lets you search photos by describing them, and can assemble short memory videos from your own photos.

All photo analysis runs locally on your device. PicKeeper does not upload your photos, videos, or their contents to us or to any third party. See our Privacy Policy for details.

These Terms apply to your use of PicKeeper, including any features, subscriptions, updates, and related services made available through the App.

2. Eligibility

You must be at least 13 years old, or the minimum age required in your country or region, to use PicKeeper. If you use PicKeeper on behalf of a company, organization, or other entity, you represent that you have authority to bind that entity to these Terms.

3. App Store Terms

PicKeeper is distributed through the Apple App Store. These Terms are between you and PicKeeper, not Apple. PicKeeper, not Apple, is solely responsible for the App and its content, except where Apple's mandatory terms or applicable law provide otherwise.

Your download and use of the App may also be governed by Apple Media Services Terms and Conditions and Apple's applicable App Store rules. If there is a conflict between these Terms and Apple's mandatory terms, Apple's mandatory terms will control to the extent required.

Apple is not responsible for providing maintenance or support for PicKeeper, except as required by applicable law. Apple and Apple's subsidiaries are third-party beneficiaries of these Terms and may enforce these Terms against you as a third-party beneficiary. 4. License to Use the App

Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to use PicKeeper on Apple-branded devices that you own or control, as permitted by Apple's App Store rules.

You may not copy, modify, reverse engineer, decompile, disassemble, sell, rent, lease, sublicense, distribute, or create derivative works from PicKeeper, except where applicable law expressly allows such activity.

5. Your Photos and Content

You are responsible for the photos, videos, screenshots, and other content in your photo library that you choose to let PicKeeper analyze ("Your Content"). You retain full ownership of Your Content.

PicKeeper reads Your Content only on your device, only after you grant photo library permission, and only to produce the results shown in the App. We do not receive, store, transmit, or have any access to Your Content.

You represent that you have the rights necessary to use Your Content with PicKeeper, and that memory videos you create and export do not infringe anyone else's rights.

6. Deleting Photos — Important

PicKeeper is a tool that helps you decide which photos to remove. You remain responsible for what gets deleted from your photo library.

PicKeeper never deletes photos silently. Items you choose to clean up are first moved to PicKeeper's in-app Recycle Bin, where they remain restorable for 30 days. Permanent deletion happens only when you explicitly empty the Recycle Bin, and iOS then shows its own system confirmation dialog before anything is removed. Deleted items also enter the iOS "Recently Deleted" album, where they can normally be recovered for a further period set by Apple.

Duplicate detection, similarity grouping, best-shot selection, and screenshot classification are automated estimates and may be imperfect. Review suggestions before accepting them. We are not responsible for photos you delete, including photos deleted by accepting an automated suggestion. Keep independent backups of anything you cannot afford to lose.

7. On-Device Analysis Features

PicKeeper uses on-device machine learning provided by Apple's operating system and models bundled with the App to score image quality, detect duplicates, read text in screenshots, and match photos to a search phrase you type. These features run offline and produce approximate results.

Optional place names for events are obtained by sending only approximate coordinates — never images — to Apple's geocoding service. If your device is offline, events simply display without a place name.

8. Subscriptions, Billing, and Renewals

PicKeeper offers auto-renewable subscriptions and a one-time lifetime purchase. Available plans, features, pricing, free trials, and billing periods are shown in the App and on the App Store at the time of purchase.

If you purchase a subscription through the App Store, payment will be charged to your Apple ID account upon confirmation of purchase. Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours prior to the end of the current period, at the price of the plan you selected.

You can manage or cancel subscriptions, and turn off auto-renewal, in your Apple ID account settings after purchase. Deleting the App does not cancel your subscription. If a free trial is offered, it converts to a paid subscription unless canceled at least 24 hours before the trial ends; any unused portion of a free trial is forfeited when you purchase a subscription.

Refunds and billing issues for App Store purchases are handled by Apple according to Apple's policies. We do not control Apple's refund decisions.

9. Acceptable Use

You agree not to use PicKeeper to:

• violate any law, regulation, contract, intellectual property right, privacy right, or other third-party right;
• analyze, organize, or export photos that you are not legally allowed to access or use;
• create or distribute unlawful, harmful, abusive, deceptive, defamatory, obscene, or infringing content;
• attempt to bypass usage limits, subscription requirements, security controls, or access restrictions;
• interfere with, disrupt, overload, reverse engineer, scrape, or misuse the App or our systems;
• extract, redistribute, or repurpose the machine-learning models bundled with the App in violation of these Terms or the models' own licenses.

10. Export and Legal Compliance

You represent and warrant that you are not located in a country or region that is subject to a U.S. Government embargo or that has been designated by the U.S. Government as a "terrorist supporting" country or region, and that you are not listed on any U.S. Government list of prohibited or restricted parties.

You agree to comply with all applicable export control, sanctions, privacy, intellectual property, consumer protection, and other laws when using PicKeeper.

11. Privacy

Our collection and use of information is described in our Privacy Policy. By using PicKeeper, you acknowledge that your use of the App is also subject to that policy.

12. Third-Party Services

PicKeeper relies on Apple services for distribution, in-app purchases, on-device machine learning, and optional geocoding, and uses analytics tools to measure aggregate app usage. These services may be subject to their own terms and policies. We are not responsible for third-party services that we do not control.

13. Intellectual Property

PicKeeper, including its design, software, features, branding, logos, and related materials, is owned by us or our licensors and is protected by intellectual property laws. These Terms do not grant you any rights in PicKeeper except for the limited license described above.

If you provide feedback, suggestions, or ideas, you grant us a non-exclusive, worldwide, royalty-free right to use them without restriction or compensation to you.

14. Availability and Changes

We may modify, suspend, limit, or discontinue any part of PicKeeper at any time. We may update the App to add, change, or remove features and subscription benefits.

We do not guarantee that PicKeeper will always be available, uninterrupted, secure, or error-free.

15. Termination

You may stop using PicKeeper at any time. We may suspend or terminate your access to PicKeeper if we reasonably believe that you violated these Terms, created risk or harm, or used the App unlawfully.

Upon termination, your right to use PicKeeper ends, but provisions that by their nature should survive will continue to apply, including ownership, disclaimers, limitations of liability, and dispute provisions.

16. Disclaimers

PicKeeper is provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.

We do not warrant that duplicate detection, quality scoring, screenshot classification, search results, or memory videos will be accurate, complete, suitable for your needs, or free from errors.

17. Limitation of Liability

To the maximum extent permitted by law, we will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, data, photos, business, goodwill, or other intangible losses arising out of or related to your use of PicKeeper.

To the maximum extent permitted by law, our total liability for any claim relating to PicKeeper will not exceed the greater of the amount you paid for PicKeeper during the three months before the event giving rise to the claim or USD $50.

Some jurisdictions do not allow certain limitations of liability, so some limitations may not apply to you.

18. Indemnity

To the extent permitted by law, you agree to defend, indemnify, and hold harmless PicKeeper, its developers, service providers, and affiliates from claims, damages, liabilities, losses, and expenses arising from Your Content, your misuse of PicKeeper, or your violation of these Terms or applicable law.

19. Governing Law

These Terms are governed by the laws applicable in the jurisdiction where PicKeeper is operated, without regard to conflict-of-law rules, except where the laws of your country or region require otherwise.

20. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we may notify you through the App, on our website, or by other reasonable means. Your continued use of PicKeeper after the effective date of updated Terms means you accept the updated Terms.
