Mushroom ID — Identify Mushrooms from a Photo

Please read these Terms carefully before using Mushroom ID. By downloading, accessing, or using the app, you agree to these Terms.
Important safety warning. Mushroom ID is for general education and entertainment only. It is not a tool for deciding whether a mushroom is safe to eat, touch, or handle. AI identification is frequently wrong, and many edible mushrooms have deadly look-alikes. Never consume, taste, or handle a wild mushroom based on this app. Always consult a qualified mycologist or poison-control expert. See Section 2.

1. About Mushroom ID

Mushroom ID ("Mushroom ID", "the App", "we", "us", or "our") is an iOS app that uses AI to suggest a likely identity for a mushroom from a photo you provide, and offers educational articles about wild mushrooms.

These Terms apply to your use of Mushroom ID, including any features, subscriptions, updates, and related services made available through the App.

2. Identification is not safety or food advice

Mushroom identification is difficult and risky. Many poisonous mushrooms closely resemble edible ones, and a wrong identification can cause serious illness or death.

You acknowledge and agree that:

To the maximum extent permitted by law, we disclaim all responsibility for any decision you make, or harm you suffer, in connection with identifying, foraging, handling, or consuming mushrooms.

3. Eligibility

You must be at least 13 years old, or the minimum age required in your country or region, to use Mushroom ID. If you use the App on behalf of a company, organization, or other entity, you represent that you have authority to bind that entity to these Terms.

4. App Store Terms

Mushroom ID is distributed through the Apple App Store. These Terms are between you and Mushroom ID, not Apple. Mushroom ID, not Apple, is solely responsible for the App and its content, except where Apple's mandatory terms or applicable law provide otherwise.

Your download and use of the App may also be governed by the Apple Media Services Terms and Conditions and Apple's applicable App Store rules. If there is a conflict between these Terms and Apple's mandatory terms, Apple's mandatory terms will control to the extent required.

Apple is not responsible for providing maintenance or support for Mushroom ID, except as required by applicable law. Apple and Apple's subsidiaries are third-party beneficiaries of these Terms and may enforce these Terms against you as a third-party beneficiary. 5. License to Use the App

Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to use Mushroom ID on Apple-branded devices that you own or control, as permitted by Apple's App Store rules.

You may not copy, modify, reverse engineer, decompile, disassemble, sell, rent, lease, sublicense, distribute, or create derivative works from Mushroom ID, except where applicable law expressly allows such activity.

6. Your Photos and Content

You are responsible for the photos and other content that you capture, select, upload, or process using Mushroom ID ("User Content").

You retain ownership of your User Content. You grant us and our service providers a limited license to process User Content only as needed to provide, maintain, secure, and improve the App's features, including AI identification.

You represent that you have all rights and permissions necessary to use your User Content with the App. Do not upload photos that you do not have the right to use, or that contain unlawful or infringing content.

7. AI-Assisted Identification

Mushroom ID uses artificial intelligence models and third-party service providers to suggest a likely identity for a mushroom in your photo. AI-generated output may be inaccurate, incomplete, outdated, or unsuitable for your purpose.

You are responsible for reviewing and independently verifying every result before relying on it. As stated in Section 2, you must never use the App as a basis for eating, handling, or otherwise interacting with wild mushrooms. The App does not provide professional advice of any kind.

8. Subscriptions, Billing, and Renewals

Mushroom ID may offer auto-renewable subscriptions. Available plans, features, pricing, free trials, and billing periods are shown in the App and on the App Store at the time of purchase.

If you purchase a subscription through the App Store, payment will be charged to your Apple ID account. Subscriptions automatically renew unless you cancel at least 24 hours before the end of the current billing period. Your account may be charged for renewal within 24 hours before the end of the current period.

You can manage or cancel subscriptions in your Apple ID account settings. Deleting the App does not cancel your subscription. Free trials, if offered, may convert to a paid subscription unless canceled before the trial ends.

Refunds and billing issues for App Store purchases are handled by Apple according to Apple's policies. We do not control Apple's refund decisions.

You represent and warrant that you are not located in a country or region that is subject to a U.S. Government embargo or that has been designated by the U.S. Government as a "terrorist supporting" country or region, and that you are not listed on any U.S. Government list of prohibited or restricted parties.

You agree to comply with all applicable export control, sanctions, privacy, intellectual property, consumer protection, and other laws when using Mushroom ID.

11. Privacy

Our collection and use of information is described in our Privacy Policy. By using Mushroom ID, you acknowledge that your use of the App is also subject to the Privacy Policy.

12. Third-Party Services

Mushroom ID relies on third-party services, including Apple services, analytics tools, cloud infrastructure, and AI model providers. These services may be subject to their own terms and policies.

We are not responsible for third-party services that we do not control, but we use them to provide and improve the App.

13. Intellectual Property

Mushroom ID, including its design, software, features, branding, logos, articles, and related materials, is owned by us or our licensors and is protected by intellectual property laws. These Terms do not grant you any rights in Mushroom ID except for the limited license described above.

If you provide feedback, suggestions, or ideas, you grant us a non-exclusive, worldwide, royalty-free right to use them without restriction or compensation to you.

14. Availability and Changes

We may modify, suspend, limit, or discontinue any part of Mushroom ID at any time. We may update the App to add, change, or remove features, including AI features and subscription benefits.

We do not guarantee that Mushroom ID will always be available, uninterrupted, secure, or error-free.

15. Termination

You may stop using Mushroom ID at any time. We may suspend or terminate your access if we reasonably believe that you violated these Terms, created risk or harm, or used the App unlawfully.

Upon termination, your right to use the App ends, but provisions that by their nature should survive will continue to apply, including ownership, disclaimers, limitations of liability, and dispute provisions.

16. Disclaimers

Mushroom ID is provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.

We do not warrant that identifications, articles, or other output will be accurate, complete, reliable, suitable for your needs, or free from errors. Without limiting Section 2, we make no warranty that any mushroom is edible, safe, or correctly identified.

17. Limitation of Liability

To the maximum extent permitted by law, we will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for personal injury, illness, loss of profits, data, or other losses arising out of or related to your use of Mushroom ID, including any decision to forage, handle, or consume mushrooms.

To the maximum extent permitted by law, our total liability for any claim relating to Mushroom ID will not exceed the greater of the amount you paid for the App during the three months before the event giving rise to the claim or USD $50.

Some jurisdictions do not allow certain limitations of liability, so some limitations may not apply to you.

18. Indemnity

To the extent permitted by law, you agree to defend, indemnify, and hold harmless Mushroom ID, its developers, service providers, and affiliates from claims, damages, liabilities, losses, and expenses arising from your User Content, your misuse of the App, your foraging or consumption decisions, or your violation of these Terms or applicable law.

19. Governing Law

These Terms are governed by the laws applicable in the jurisdiction where Mushroom ID is operated, without regard to conflict-of-law rules, except where the laws of your country or region require otherwise.

20. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we may notify you through the App, on our website, or by other reasonable means. Your continued use of Mushroom ID after the effective date of updated Terms means you accept the updated Terms.
